OLD LYME ZONING COMMISSION
MINUTES OF PUBLIC HEARING
Monday, March 9, 2009


The Old Lyme Zoning Commission held a Public Hearing on Monday, March 9, 2009 at 7:30 p.m. in the Auditorium of Memorial Town Hall.  Members present were Jane Cable (Acting Chairman), Jane Marsh (Secretary), Beth Sullivan (Alternate, seated), Ted Kiritsis (Alternate, seated) and Patrick Looney.  Also present was Ann Brown, Zoning Enforcement Officer.

Acting Chairman Cable called the Public Hearing to order at 7:32 p.m.
        
1.  Special Permit Application/Coastal Site Plan Application to construct a structure in the Gateway Conservation Zone in excess of 4,000 square feet, 7 Town Landing Road, Steven A. and Barbara Gaudio, applicants.

Acting Chairman Cable noted that they are in receipt of a letter from the applicant’s attorney requesting that the Public Hearing be continued to the April Regular Meeting.  She noted that the April Regular Meeting with be held on Monday, April 13, 2009.

2.  Petition to Amend the Old Lyme Zoning Regulations to correct and clarify technical errors contained in the comprehensive revision of the Old Lyme Zoning Commission, as adopted on March 7, 2008, Old Lyme Zoning Commission, applicant.

Ms. Marsh read the legal ad as published in The New London Day on February 24 and Tuesday, March 3, 2009.

Acting Chairman Cable explained that Ms. Brown, after diligent research, discovered that Zoning was enacted on January 11, 1941.  She noted that several definitions are being changed and she read each current and proposed definition individually.  There were no comments from the public.



Acting Chairman Cable explained the remainder of the proposed text changes and the typographical corrections.

Tom Unger, questioned the difference between a basement and a cellar.  Ms. Brown stated that one can walk directly outside from a basement and cannot from a cellar.  She read the definitions for clarity.

A member of the audience pointed out that Section 9.1.3.2 (f) says R-10 Zone and should read R-10 District.  The Commission agreed to make this correction.

No one present spoke in favor of or against the proposed text amendments.

A motion was made by Jane Marsh, seconded by Patrick Looney and voted unanimously to close the Public Hearing for the Petition to Amend the Old Lyme Zoning Regulations to correct and clarify technical errors contained in the comprehensive revision of the Old Lyme Zoning Commission, as adopted on March 7, 2008, Old Lyme Zoning Commission, applicant.

Acting Chairman Cable adjourned the Public Hearing at 8:06 p.m.
